Terms, Privacy, Refund Policies

Made and entered into by and between THE OHANA PROJECT CR, Registration Number:

3-102-862269, Guanacaste, Tamarindo 50309, Costa Rica.

1. Rental Terms and Deposit

1.1 A deposit of $200 USD will be held by THE OHANA PROJECT CR for the entire duration of the rental.

1.2 The deposit will be released in full upon the agreed end date and time of the rental of the scooter and all rented items (helmets, safety straps, phone holders, surf racks, etc.) are returned in the same condition as when given, minus a 3.9% + $0.30 Stripe tax fee.

1.3 Refunds are not permitted if THE RENTER decides to cut short their rental duration.

However, the deposit will be returned in full if all rented products are returned in the same condition.

2. Cancellation and Refund Policy

2.1 Cancellation is not allowed 48 hours before the reservation date.

2.2 If cancellation is made 7 days before the reservation date, a 50% refund will be provided

2.3 THE RENTER will be charged for the full rental duration if cancelled 24 hours before the reservation date.

3. Renter’s Obligations

3.1 THE RENTER takes on full responsibility for THE VEHICLE and any risks associated with it throughout the rental period.

3.2 THE RENTER shall:

• Ensure the vehicle remains safe and in the same condition as when provided.

• Follow instructions on how to safely lock and operate the scooter as explained by THE

OHANA PROJECT CR.

3.3 THE RENTER shall not:

• Hire, lend, or permit anyone other than the additional driver to use the vehicle.

• Use the vehicle for unlawful purposes, overloading, racing, or carrying passengers for

reward.

• Drive the vehicle while under the influence of alcohol or drugs. If caught, the rental will

be terminated, and the deposit will not be returned.

• Permit towing, repairs, or servicing unless authorised by THE OHANA PROJECT CR.

3.4 THE RENTER shall protect the vehicle from theft or damage, lock and immobilize it when not in use, and ensure fuel levels are returned as provided. Failure to return the same fuel level will incur a $20 fee.

3.5 THE RENTER is responsible for returning rented items in the same condition. If any rented items are damaged or not returned, THE OHANA PROJECT CR may charge THE RENTER the cost of repair or replacement.

3.6 THE RENTER is responsible to pay a service fee of 25% of daily rental to cover THE OHANA PROJECT CR employee if the bike is required to be taken to a mechanic due to damages caused by THE RENTER.

4. Damage, Loss, and Theft

4.1 THE OHANA PROJECT CR provides insurance coverage for the rented vehicle of up to 80% for major damages but does not cover for minor damages like aesthetic damages etc.

THE RENTER has full liability for any damage, theft, or accidents during the rental period.

4.2 If the vehicle is not returned in the same condition or is stolen, THE RENTER consents to THE OHANA PROJECT CR deducting amounts exceeding the deposit to repair or replace the vehicle.

4.3 If any product rented to THE RENTER is damaged or lost, THE OHANA PROJECT CR reserves the right to charge for mechanic fees, staff fees, maintenance fees, or any other costs necessary to restore the product to its original condition.

5. Accident and Incident Reports

5.1 In case of a collision, theft, or loss involving the vehicle, THE RENTER shall:

• Immediately report the event to THE OHANA PROJECT CR and the police or traffic department.

• Complete all required documents within 24 hours of the incident.

• Assist THE OHANA PROJECT CR and its insurers in any related matters.

6. Deposit and Refund Conditions

6.1 THE OHANA PROJECT CR will provide receipts for any charges related to damages or loss.

6.2 If all conditions are met, THE RENTER’s deposit will be refunded excluding the Stripe tax fee.

7. Compliance and Dispute Resolution

7.1 THE RENTER agrees to all terms and conditions outlined in this contract by placing the deposit on STRIPE to THE OHANA PROJECT CR.

7.2 THE OHANA PROJECT CR reserves the right to charge THE RENTER for breaches of this agreement.

7.3 Disputing charges related to breaches of these terms constitutes a violation of this agreement.

7.4 THE OHANA PROJECT CR will remain communicative and provide evidence and receipts for any charges if damages or loss occur.
